regulations relating to the protection of personal data, such as the Personal Data Protection Act (Wbo) and – as of 25 May 2018 – the General Data Protection Regulation (GDPR). In this Privacy Statement, Zilver Advocaten explains how your personal data are processed.

Zilver Advocaten is responsible for the processing of your personal data. This means that Zilver Advocaten determines the purposes and means for the processing. Zilver Advocaten is responsible for compliance with the applicable laws and regulations

Zilver Advocaten processes your personal data for various purposes, including:
- to be able to contact you;

- for carrying out the legal services for which we are engaged;
- to carry out the administration and to comply with administrative obligations that the law and supervisors impose on us;

Zilver Advocaten may decide to further process the personal data processed for these purposes for other purposes, but only if this is compatible with the abovementioned purposes.

Zilver Advocaten processes the following (types or categories) of personal data:
- contact details (name and address details, titles, telephone numbers and similar data required for communication), date of birth, nationality, place of birth, gender, bank account number, identity document;
- information relating to the handling of the case or the settlement of the dispute;
- data in the context of calculating and recording fees and expenses, making payments and collecting receivables;
- other data required or necessary to ensure compliance with legislation or regulations;
- in some cases a statement about behavior (VOG);
- data relating to the purchase of services or products;
- data related to a visit to our website, such as identification and communication with visitors to the website or data recorded to keep visitor statistics of our website up to date.
4. THE LEGAL BASES FOR THE PROCESSING OF YOUR PERSONAL DATA
A legal basis is required for the lawful processing of your personal data. In that context, Zilver Advocaten can process your personal data on the basis of one or more of the following legal bases:
- you have given permission for the processing of your personal data for the aforementioned purposes;
- the processing of your personal data is necessary for the execution of an agreement to which you are a party, or to take action at your request before the conclusion of an agreement;
- the processing of your personal data is necessary in order to comply with a statutory obligation that applies to Zilver Advocaten. This may include, among other things, legal obligations with regard to the accounting of Zilver Advocaten, tax obligations, obligations in the context of court orders and obligations based on other mandatory laws and regulations;
- the processing of your personal data is necessary to protect the vital interests of you or of another natural person;
- the processing is necessary for the defense of the legitimate interests of Zilver Advocaten or of a third party, if and to the extent permitted under the applicable (privacy) laws and regulations. This could include:

In light of the purposes mentioned in paragraph 2 above, Zilver Advocaten can provide your personal details to persons within the organization of Zilver Advocaten. The transfer of your personal data outside the organization of Zilver Advocaten
In light of of the purposes mentioned in paragraph 2 above, Zilver Advocaten may also provide your personal data to persons outside the organization of Zilver Advocaten. The persons to whom and to what extent your personal data will be provided will also depend on the purposes for which the personal details in question have been processed.
Your personal data can in any case be provided to:
- other parties (including any representatives) that are directly or indirectly involved in your engagement with Zilver Advocaten;
- archive managers of Zilver Advocaten;
- judicial authorities;
- bailiffs;
- external auditors of Zilver Advocaten;
- external advisors of Zilver Advocaten;

- IT service providers of Zilver Advocaten;

6. THE TRANSFER OF YOUR PERSONAL DATA TO THIRD COUNTRIES
In light of the purposes mentioned in paragraph 2 above, Zilver Advocaten can provide your personal data to persons or organizations located in countries
outside the European Union. These are so-called ‘third countries’.
The European Commission has decided that a number of third countries provide an adequate level of protection with regard to your personal data. A list of these countries can be consulted on the website of the European Commission.
It is also possible that third countries do not provide an adequate level of protection with regard to your personal data. If Zilver Advocaten transfers your personal data to persons or organizations in such countries, Zilver Advocaten will provide appropriate safeguards for the security of your personal data, to the extent that it is necessary under the law to provide such safeguards. For example, it is not necessary to offer adequate safeguards if you have expressly agreed to the transfer of your personal data after you have been informed of the risks involved.

7. THE SECURITY OF YOUR PERSONAL DATA
Zilver Advocaten attaches great importance to the security and protection of your personal data and, taking into account the state of technology, ensures appropriate technical and organizational measures to ensure a security level appropriate to the risk. In the event Zilver Advocaten makes use of services of third parties, for example an IT supplier, Zilver Advocaten will, for the protection of personal data, lay down agreements about adequate security measures in a processor agreement.
8. THE PERIOD DURING WHICH YOUR PERSONAL DATA WILL BE RETAINED
Zilver Advocaten does not retain your personal data longer than necessary for the realization of the purposes for which this data is processed (see paragraph 2 above), but for at least as long as required by applicable laws and regulations.
9. YOUR RIGHTS WITH REGARD TO YOUR PERSONAL DATA (COLLECTION, RECTIFICATION, DELETION, LIMITATION, OBJECTION, DATA LIABILITY, WITHDRAWAL PERMISSION, SUBMISSION OF COMPLAINT)
You have the right to obtain information about whether or not your personal data are being processed. If Zilver Advocaten processes your personal data, you also have the right to:
- access to your personal data (article 15 GDPR);
- rectification of your personal data (article 16 GDPR);
- erasure of your personal data (article 17 GDPR);
- limitation of the processing of your personal data (article 18 GDPR);
- object to the processing of your personal data (article 21 GDPR);
- portability of your personal data (article 20 GDPR);
- insofar as the processing of your personal data is (exclusively) based on your consent: the right to revoke this consent at any time (article 7 GDPR);
- Submitting a complaint to the supervisory authority, being the Dutch Data Protection Authority (Article 77 of the GDPR).
10. YOUR POSSIBLE OBLIGATIONS TO PROVIDE YOUR PERSONAL DATA AND THE POSSIBLE CONSEQUENCES IF THESE OBLIGATIONS ARE NOT FULFILLED
You may be legally or contractually obliged to provide certain personal data. In addition, the provision of certain personal data for Zilver Advocaten may be a necessary condition for concluding an agreement with you (for example name, address and residence details). If this is the case, then Zilver Advocaten will inform you of this. Failure to comply with these obligations may lead, among other things, to Zilver Advocaten not entering into an agreement with you, or – if an agreement has already been concluded between you and Zilver Advocaten – it may have consequences for the agreement between you and Zilver Advocaten.
11. THE EXISTENCE OF AUTOMATED DECISIONMAKING
Zilver Advocaten does not use automated decisionmaking (that is, a decision based solely on automated processing, including profiling). However, Zilver Advocaten may decide to make use of this in the future if and insofar as:
- this is necessary for the execution of an agreement between you and Zilver Advocaten;
- this is permitted by applicable laws and regulations, provided that there are appropriate measures to protect your rights and freedoms and legitimate interests; or
- this is based on your explicit consent; in which case Zilver Advocaten will inform you in advance.
12. USE SOCIAL MEDIA
On the website (s) of Zilver Advocaten buttons (also called buttons) and / or links are included to promote or share web pages on social (media) networks or websites of third parties, such as Twitter, Linkedin or Facebook. Zilver Advocaten does not supervise and is not responsible for the processing of your personal data by and through such third parties. The use of these media is therefore at your own risk. Before you make use of these services from third parties, it is advisable to first read the privacy statement of those third parties.
13. WEBSITE AND COOKIES
In order to increase the user-friendliness of the website(s) of Zilver Advocaten, use is made of socalled ‘cookies’. A cookie is a small text file that is placed on your computer, tablet or smartphone during your visit to the website(s) of Zilver Advocaten. You can refuse the use of these cookies at any time, although this may limit the functionality and ease of use of the website(s).
The website of Zilver Advocaten uses cookies from Google Analytics to follow, in general terms, the user behavior and general trends and to obtain reports. This concerns usage statistics such as the number of different visitors, the pages that are visited in particular and the average duration of a visit. This helps to improve the functioning of the website(s). We have entered into a processor agreement with Google to ensure that personal data collected in the context of Google Analytics is only used to provide Zilver Advocaten with insight into the way in which the website is used. Zilver Advocaten has adjusted the settings of Google Analytics so that the data may not be used by other Google services, and that the last figures of all IP addresses collected in this context are immediately deleted to make it more difficult to trace them back to a specific visitor.
